Family Law

Family law is our focus. We are here to help, but we don’t believe in “one size fits all” solutions. Although most divorcing couples face the same issues, such as child custody, child support, spousal support, and property division, not every couple must go to court. Southpark Family Law attorneys will discuss your situation with you to determine the best and most cost-effective way to handle your divorce.

Negotiated Settlement

In many cases, we are able to negotiate and reach agreements regarding the issues of child custody, child support, spousal support and property division without ever setting foot in a courtroom. We can communicate with your spouse or his or her attorney to attempt to reach agreeable terms related to your separation. If you and your spouse have already discussed many issues and have made decisions together, we can prepare the necessary legal documents to capture your agreement.

Collaborative Divorce

If you and your spouse are committed to reducing conflict and working together to achieve the best possible outcome for your family, then Collaborative Divorce may be the ideal path for you to resolve the issues related to your divorce. Using the Collaborative Process, both spouses and their attorneys commit to keeping the matter out of court. The parties attempt to reach agreement on issues such as custody, child support, spousal support, and division of marital property through a series of settlement conferences, working with the support of financial neutrals and mental health professionals.

The attorneys at Southpark Family Law can discuss with you whether mediation might be appropriate for your family, and which type of mediation would work best. Some couples choose to sit down with a mediator together to work through their issues without attorneys present, and then have an attorney capture the resulting terms in legally binding documents. However, in some situations, it may be more appropriate for your attorney to attend mediation with you to guide you along the way and advocate for you. We can discuss your particular situation with you and advise you whether mediation would be appropriate in your case.

Some couples agree to have their divorce-related issues decided by an arbitrator. In arbitration, the parties present evidence and argue their positions before a third-party neutral arbitrator, whose decision is legally binding.

In some cases, it may be necessary to go to court to protect your rights. If the parties are unable to reach an agreement out of court, then a judge may have to decide the issues of custody, child support, spousal support, and division of marital property. We regularly appear in court in Mecklenburg and all the surrounding counties. We are strong, effective advocates for your rights and will work hard to achieve a positive outcome in your case.

Child Custody

Child custody was once thought of as an issue dealt with only by divorcing couples, but that is no longer the case. We represent clients in a wide variety of situations where custody is at issue, including grandparents seeking custody of a grandchild, other relatives seeking custody of a child in their family, same sex couples seeking to establish custody of a child born during their relationship, and even cases involving custody disputes between a surrogate and the gestational parents. We are also frequently involved in cases involving the Department of Social Services. Each child custody situation is so very different, which is why it is important to have an experienced attorney working for you. Your family is too important to risk to chance.

Child Support

Child support is a right that can be pursued even outside of divorce court. If you are caring for a child, even if you are not the child’s biological parent, you may very well be entitled to receive financial support. It can be very difficult to understand the child support laws and navigate the court system on your own. We can assist you in seeking child support from a financially responsible party, regardless of whether you have been married to that person. Make sure you have a Southpark family law attorney on your side to seek the financial support you deserve.
